Article 1. Definitions
In these general terms and conditions the following terms are used in the following sense unless expressly indicated otherwise.
Restaurant Pieterman Volendam: the user of these general terms and conditions.
Client: the other party of Restaurant Pieterman Volendam.
Article 2 General
- These terms and conditions apply to every offer, quotation and agreement between Restaurant Pieterman Volendam and a client to which Restaurant Pieterman Volendam has declared these terms and conditions applicable, insofar as the parties have not expressly deviated from these terms and conditions in writing.
- Any deviations from these general terms and conditions shall only be valid if expressly agreed in writing.
Article 3. Offers and tenders
- Quotations made by Restaurant Pieterman Volendam are without obligation; they are valid for 14 days, unless otherwise indicated. Restaurant Pieterman Volendam shall only be bound by its offers if the other party confirms acceptance thereof in writing within 14 days, unless otherwise indicated.
- Assignments to organise meetings in the broadest sense of the word (with or without full catering), if the price is made dependent on the number of participants and this number is provisionally stated at the time of the assignment, shall only be accepted on the condition that the other party informs Restaurant Pieterman Volendam of the correct number of participants at least five working days prior to the event. Pieterman Volendam Restaurant has the right to demand this in writing.
- Prices for catering (whether or not complete) are calculated on the basis of the number of persons specified by the other party. The payment conditions laid down in Article 5 shall apply. If no reservation regarding the number of participants was made when the order was placed, additional consumption will be charged to the other party afterwards on a subsequent costing basis. If the other party fails to fulfil its obligation to state the number of participants, Restaurant Pieterman Volendam is entitled to calculate the price on the basis of the provisionally stated number of participants.
- Pieterman Volendam Restaurant is entitled to charge the other party for price increases that occur after the agreement is concluded, on the basis of the price index figure for family consumption, or any index figure that replaces it. Price increases based on the aforementioned index figure will only be charged to the other party as of 1 January of any year following the calendar year in which the agreement in question was concluded.
Article 4. Delay
- If the client is not present at the agreed time, additional costs incurred by Pieterman Volendam Restaurant will be charged to the client.
- Major delays caused by the client may result in the cancellation of (parts of) the appointments, without any right to refund for the client.
Article 5. PAYMENT
- For a total amount of ¤ 1,000 or more, the client will pay 25% of the total price upon signing the agreement. The remaining amount will be paid to Restaurant Pieterman Volendam after completion of the services in cash, by bank transfer or by electronic payment.
- If the down payment is not made in time, Restaurant Pieterman Volendam has the right to dissolve the agreement without judicial intervention or notice of default, without the client being entitled to any compensation in this respect. All this without prejudice to all rights of Pieterman Restaurant Volendam.

Article 6. Catering
- Catering will only be provided by Restaurant Pieterman Volendam itself, unless expressly agreed otherwise between Restaurant Pieterman Volendam and the client.
- The Client is obliged to pay catering costs, insofar as they are not included in the quotation, to Pieterman Volendam Restaurant within 14 days of the invoice date.
- If the client fails to fulfil his payment obligation within 14 days, he shall be in default without any notice of default being required and the amount he owes Restaurant Pieterman Volendam shall be increased by the statutory interest and extrajudicial collection costs. These extrajudicial collection costs amount to 15% of the invoice amount, with a minimum of € 115.
Article 7. Cancellation by the client
- In case of cancellation after the final confirmation, the customer is always obliged to pay an administration fee of € 25.
- In case of cancellation between 2 and 1 weeks before the agreed delivery date, the customer is obliged to pay 20% of the total price.
- In case of cancellation between 7 and 2 days before the delivery date, the customer is obliged to pay 50% of the total price.
- In the event of cancellation within 48 hours prior to the delivery date, the Customer is obliged to pay 100% of the total price.
- Cancellations can only be made in writing or by e-mail, preferably preceded by the earliest possible telephone notification of the cancellation.
Article 8. Cancellation by restaurant pieterman Volendam
- Restaurant Pieterman Volendam is entitled to cancel the agreement due to force majeure. Force majeure shall be understood to mean any foreseen or unforeseen, foreseeable or unforeseeable circumstances that hamper the performance of the agreement by Restaurant Pieterman Volendam to such an extent that performance becomes reasonably impossible or difficult. Such circumstances also include such circumstances with regard to persons and/or services and/or institutions that Restaurant Pieterman Volendam wishes to make use of for the performance of the agreement as well as everything that applies to the aforementioned as force majeure or as suspensive or resolutive condition. If possible, Restaurant Pieterman Volendam will offer the other party (a) replacement possibilities at the agreed time or during a different period on the same conditions.
- In the event referred to in paragraph 1 the other party has the right to refuse the alternative offered by Restaurant Pieterman Volendam. A refusal must be communicated to Restaurant Pieterman Volendam in writing and at the latest one week after the offer was made, in default of which the offer will be accepted.
Article 9. Partial cancellation
- In the event of a reduction in the number of participants greater than 10%, the cancellation provisions in Article 7 of these terms and conditions shall apply.
- Additional participants who have not been reported 48 hours prior to delivery will be charged a reasonable additional fee.
Article 10. Liability of client
- The Customer is liable for any damage caused by the Customer and its guests and employees to the property of Restaurant Pieterman Volendam, its employees or third parties.
Article 11. Complaints
- Any complaints about the services provided, including catering, should be reported immediately on the evening itself.
- Pieterman Volendam Restaurant can never be held liable for a higher amount than the total amount agreed.
Article 12. Applicable law and competent court
- These terms and conditions and all agreements concluded under these terms and conditions shall be exclusively governed by Dutch law.
- Any disputes arising from these terms and conditions and agreements concluded under these terms and conditions shall be submitted exclusively to the competent court in the district of Amsterdam.
- Disputes shall be deemed to exist from the moment one of the parties notifies the other party thereof in writing.
